TERMS AND CONDITIONS OF USE – iSOKO ZAMBIA
Effective Date: 15 June 2025
1. DEFINITIONS
1.1 "Service" refers to the iSOKO Platform, including its website, Android and iOS applications, USSD services, and any other digital or offline services provided by the Zambia Association of Chambers of Commerce and Industry (ZACCI) in connection with the iSOKO system.
1.2 "iSOKO Platform" means the digital marketplace and trade facilitation platform operated by ZACCI, with support from TradeMark Africa (TMA).
1.3 "Company" refers to ZACCI, its officers, employees, and authorised partners.
2. ABOUT US
Zambia Association of Chambers of Commerce and Industry (ZACCI): The apex body of chambers of commerce and industry in Zambia, representing the collective interests of the Zambian private sector and facilitating trade and investment across the country.
TradeMark Africa (TMA): Established in 2010, TMA is an Aid-for-Trade organisation focused on increasing intra-African trade, making it more inclusive, sustainable, and pro-poor.
3. ELIGIBILITY AND ACCOUNT REGISTRATION
(a) Users must be at least 18 years old or represent a duly registered business entity under Zambian law.
(b) Users are responsible for maintaining the confidentiality of their login credentials.
(c) Users may request Account closure by contacting [ZACCI email].
4. USER CONTENT AND RESPONSIBILITIES
Users retain ownership of all Content they submit. The Company may remove Content deemed unlawful or in violation of these Terms.
5. ORDERS AND PAYMENTS
We do not guarantee the quality, safety, or legality of items posted on this platform. In the event of a dispute, you release ZACCI and all affiliated parties from all claims and damages arising from such disputes.
6. PROHIBITED USES
Users are prohibited from: illegal transactions; listing prohibited items; uploading malicious code; impersonation; automated data extraction; and harassment or discriminatory practices.
7. INTELLECTUAL PROPERTY
All intellectual property rights in the iSOKO Platform are owned by or licensed to ZACCI and TMA.
8. COPYRIGHT POLICY
The Company complies with the Zambia Copyright and Performance Rights Act (Cap. 406). To report infringement, contact [ZACCI email].
9. DISCLAIMER OF WARRANTIES
The Platform is provided "as is" and "as available" without warranties of any kind.
10. LIMITATION OF LIABILITY
To the fullest extent permitted by Zambian law, the Company shall not be liable for indirect or consequential damages arising from use of the Platform.
11. TERMINATION
The Company may suspend or terminate Accounts for violations, fraudulent activities, or extended inactivity. Users may terminate by contacting [ZACCI email].
12. GOVERNING LAW AND DISPUTE RESOLUTION
12.1 These Terms are governed by the laws of the Republic of Zambia.
12.2 Disputes shall first be resolved through mediation by ZACCI within 30 days.
12.3 If mediation fails, disputes shall be referred to arbitration under the Zambia Institute of Advanced Legal Education (ZIALE) Arbitration Rules, Lusaka, with the decision being final and binding.
13. AMENDMENTS, FORCE MAJEURE, AND ACKNOWLEDGMENT
The Company reserves the right to modify these Terms at any time. By using the Platform, Users confirm they have read, understood, and agree to be bound by these Terms and will comply with all applicable Zambian laws and regulations.
